Advocate for POCSO Act, CSAM and Child Pornography

POCSO Act, CSAM and Child Pornography in India: Law, Punishment, Cyber Crime and Child Safety

Child Sexual Abuse Material (CSAM), commonly referred to as child pornography, is one of the most serious forms of child sexual exploitation and cybercrime. In India, offences involving children and sexually explicit material can attract serious criminal consequences under the Protection of Children from Sexual Offences Act, 2012 (POCSO Act) and the Information Technology Act, 2000 (IT Act).

With the rapid growth of smartphones, social media, messaging applications, cloud storage, online gaming communities and AI-generated content, the risk of children being targeted online has increased. Parents, schools, companies and internet users should understand what CSAM is, what the law provides, how children can be protected, and what should be done if suspected child sexual abuse material is encountered.

What is CSAM?

CSAM stands for Child Sexual Abuse Material.

CSAM refers to material that depicts or otherwise involves a child in sexually explicit or sexually exploitative circumstances.

It may exist in different forms, including:

☞ Photographs
☞ Videos
☞ Digital images
☞ Recorded livestreams
☞ Digitally created or manipulated material
☞ Other electronic material involving the sexual exploitation or abuse of a child

The term CSAM is increasingly preferred over “child pornography” because the material represents the sexual abuse or exploitation of a child rather than consensual adult sexual activity.

What is Child Pornography?

The term child pornography is commonly used to describe sexually explicit material involving children.

However, from a child-protection perspective, the term Child Sexual Abuse Material (CSAM) is more appropriate because it highlights the abuse and exploitation involved.

In India, activities involving such material may attract provisions under the POCSO Act, Information Technology Act and other applicable criminal laws depending on the facts of the case.

What is the POCSO Act?

The Protection of Children from Sexual Offences Act, 2012, commonly known as the POCSO Act, is a special law designed to protect children from sexual assault, sexual harassment and sexual exploitation.

Under POCSO:

A child means a person below 18 years of age.

The Act contains specific provisions dealing with the use of children for pornographic purposes and the storage or possession of child pornographic material.

POCSO Section 13 – Using a Child for Pornographic Purposes

Section 13 of the POCSO Act deals with the use of a child for pornographic purposes.

A child may be considered to have been used for pornographic purposes where the child is involved in the creation or production of pornographic material through different forms of media or technology.

Depending on the circumstances, issues may arise regarding:

☞ Creating photographs or videos involving a child
☞ Producing sexual content using a child
☞ Recording sexually explicit material involving a child
☞ Using electronic technology to exploit a child
☞ Involving a child in the preparation or production of pornographic material

The exact applicability of the provision depends on the facts and evidence of the particular case.

POCSO Section 14 – Punishment

Section 14 of the POCSO Act provides punishment for using a child for pornographic purposes.

First Conviction

The punishment may include:

Imprisonment of not less than 5 years and fine.

Second or Subsequent Conviction

The punishment may include:

Imprisonment of not less than 7 years and fine.

Where the child is subjected to pornographic activity along with other sexual offences, additional provisions of the POCSO Act may become applicable depending upon the facts.

Therefore, using a child to create sexually explicit material can result in serious criminal liability.

POCSO Section 15 – Storage or Possession of Child Pornographic Material

Section 15 of the POCSO Act is particularly important in cases involving the storage or possession of child pornographic material.

The law provides different levels of punishment depending upon the circumstances, including the purpose for which the material was stored or possessed.

It is therefore incorrect to assume that:

“I did not create the material, so there cannot be any legal issue.”

The investigation may examine how the material came onto the device, whether the person had knowledge of it, whether the person exercised control over it, the purpose for which it was retained, and whether there was an intention to transmit or distribute it.

Section 15(1) POCSO

Where a person stores or possesses child pornographic material in circumstances covered by Section 15 and fails to delete, destroy or report it as required, with the relevant intention to share or transmit it, punishment may arise under the provision.

For a first offence, the law provides for a minimum fine of:

₹5,000

For a subsequent offence:

₹10,000 minimum fine

The precise application depends on the statutory requirements and facts of the case.

Section 15(2) POCSO

Where child pornographic material is stored or possessed for the purpose of:

☞ Transmitting
☞ Propagating
☞ Displaying
☞ Distributing

the material, except for legally permitted purposes such as reporting or use as evidence, punishment may extend to:

Up to 3 years imprisonment, or fine, or both.

Section 15(3) POCSO – Commercial Purpose

Where child pornographic material is stored or possessed for a commercial purpose, the punishment can be significantly more serious.

First Conviction

3 to 5 years imprisonment, or fine, or both.

Second or Subsequent Conviction

5 to 7 years imprisonment and fine.

Commercial exploitation, selling, distribution or financial benefit connected with CSAM can therefore attract severe criminal consequences.

Information Technology Act Section 67B

In online child pornography and CSAM cases, Section 67B of the Information Technology Act, 2000 is also highly important.

Section 67B deals with electronic material depicting children in sexually explicit or otherwise prohibited circumstances and covers several activities depending on the facts.

These may include:

☞ Publishing
☞ Transmitting
☞ Creating certain electronic material
☞ Collecting
☞ Seeking
☞ Browsing
☞ Downloading
☞ Advertising
☞ Promoting
☞ Exchanging
☞ Distributing

The provision also addresses electronic facilitation of sexual exploitation or abuse of children.

Punishment Under IT Act Section 67B

For a first conviction, Section 67B may provide:

Up to 5 years imprisonment and fine up to ₹10 lakh.

For a second or subsequent conviction:

Up to 7 years imprisonment and fine up to ₹10 lakh.

The actual sections and punishment in an individual case depend on the facts, evidence and charges established during investigation and trial.

Why Can Both POCSO and IT Act Apply?

A single incident may involve multiple offences.

For example:

Child used to create pornographic material

→ POCSO Sections 13 and 14 may become relevant.

Electronic transmission or publication

→ IT Act Section 67B may become relevant.

Storage or possession

→ POCSO Section 15 may become relevant depending on the circumstances.

Commercial storage or possession

→ POCSO Section 15(3) may become relevant.

Therefore, the complete legal position cannot be determined merely by looking at one section.

What If CSAM Is Received on WhatsApp or Telegram?

If suspected CSAM is received through WhatsApp, Telegram, Instagram, email or another online platform, it should not be forwarded or circulated.

Do not:

❌ Forward it to friends
❌ Post it in a WhatsApp group
❌ Upload it to Telegram
❌ Repost it on social media
❌ Send it to another device
❌ Upload it to cloud storage
❌ Send it to someone “for verification”

Further circulation can create additional legal complications.

What to Do If CSAM Is Accidentally Received

This is an important practical situation.

If someone unexpectedly receives suspected CSAM:

Step 1 – Do Not Forward It

Do not send it to another person or group.

Step 2 – Do Not Circulate It

Do not upload or repost the material on social media.

Step 3 – Avoid Making Unnecessary Copies

Do not create multiple copies or transfer the material between devices.

Step 4 – Preserve Relevant Identifying Information

For reporting purposes, information such as:

☞ Sender username
☞ Account details
☞ Profile information
☞ Date and time
☞ Group or channel information
☞ Relevant message information

may be important.

However, the material itself should not be unnecessarily copied or circulated.

Step 5 – Report It

The matter can be reported to the appropriate cybercrime or police authority through the applicable reporting mechanism.

Should CSAM Be Saved as Evidence?

Ordinary users should avoid making copies of suspected CSAM merely for evidence purposes.

If reporting is necessary:

☞ Preserve the original device where appropriate
☞ Preserve relevant account information
☞ Avoid forwarding the material
☞ Do not alter or destroy relevant digital evidence
☞ Provide information to investigating authorities through the appropriate process

Professional digital evidence handling is particularly important in serious cybercrime investigations.

POCSO Section 19 – Reporting of Offences

The POCSO Act gives significant importance to reporting offences against children.

Where a person has knowledge or reasonable apprehension that an offence under POCSO has been committed or is likely to be committed, the reporting framework under Section 19 may become applicable.

Therefore, suspected child sexual abuse or exploitation should not simply be ignored.

POCSO Section 21 – Failure to Report

Section 21 of the POCSO Act deals with punishment for failure to report or record a POCSO offence as required by law.

The Act also provides consequences in certain circumstances for persons responsible in institutions.

Schools, educational institutions, organisations and other responsible persons should therefore understand their reporting responsibilities when information concerning child sexual abuse becomes available.

How to Protect Children From Online Sexual Abuse

Child online safety is not limited to installing parental-control software.

Parents should regularly communicate with children about digital safety.

1. Be Careful With Unknown People

Children should understand that online identities can be fake.

A person claiming to be a particular age or identity may not actually be that person.

2. Do Not Share Private Photographs

Children should never be pressured into sharing private photographs or videos with strangers.

3. Protect Personal Information

Children should avoid sharing:

☞ Home address
☞ School details
☞ Phone number
☞ Live location
☞ Passwords
☞ Private photographs

with unknown persons.

4. Be Careful With Video Calls

Pressure to participate in private video calls or turn on a camera can be a warning sign.

5. Do Not Keep Secret Online Relationships

If someone online tells a child:

“Do not tell your parents.”

the child should be encouraged to tell a trusted adult immediately.

What is Online Grooming?

Online grooming occurs when an offender attempts to establish trust or an emotional relationship with a child and gradually moves the interaction toward sexual exploitation.

A possible pattern can involve:

Friendship → Trust → Private Chat → Personal Information → Private Images → Sexual Conversation → Threats or Blackmail

Not every case follows this exact pattern, but parents and children should understand these warning signs.

What is Child Sextortion?

Child sextortion can occur when someone obtains a child’s private image or video and threatens to publish or distribute it unless the child or family provides money or additional material.

For example:

“Send money or I will publish the photograph.”

This can become a serious cybercrime and child-exploitation situation.

The child should:

☞ Tell a trusted adult
☞ Stop sending additional material
☞ Preserve relevant threatening communications
☞ Record relevant account information
☞ Avoid paying without obtaining appropriate help
☞ Report the matter to the appropriate authorities

Most importantly, the child should not be blamed.

Protection of Children from Sexual Offences Act, 2012 (POCSO Act) और Information Technology Act, 2000 (IT Act) की विभिन्न धाराएँ लागू हो सकती हैं।

☞ Photograph
☞ Video
☞ Digital image
☞ Recorded livestream
☞ Digitally created material

POCSO Act

Protection of Children from Sexual Offences Act, 2012,

POCSO Act

POCSO Section 14 – Punishment

First Conviction

Subsequent Conviction

Possession

Section 15(1) POCSO

5,000 fine

10,000 fine

का provision है।

Section 15(2) POCSO

यदि child pornographic material को:

☞ Transmit
☞ Propagate
☞ Display
☞ Distribute

Section 15(3) POCSO

First Conviction

Subsequent Conviction

IT Act Section 67B और Child Pornography

Facts

☞ Publishing
☞ Transmitting
☞ Creating certain electronic material
☞ Collecting
☞ Seeking
☞ Browsing
☞ Downloading
☞ Advertising
☞ Promoting
☞ Exchanging
☞ Distributing

IT Act Section 67B की Punishment

Section 67B

First Conviction

Subsequent Conviction

→ IT Act Section 67B relevant

→ POCSO Section 15 relevant

→ POCSO Section 15(3) relevant

❌ Friend
❌ WhatsApp group

Step 1 – Forward

Step 3 – Unnecessary copies

Step 4 – Relevant information note

☞ Sender account
☞ Username
☞ Profile information
☞ Date और time
☞ Group/channel information
☞ Message details

☞ Relevant account information

POCSO Section 19 – Reporting

POCSO Section 21 – Failure to Report

2. Private Photos Share

3. Personal Information

☞ Address
☞ School details
☞ Phone number
☞ Live location
☞ Password
☞ Personal photographs

4. Unknown Video Calls

Unknown person द्वारा camera on करने या private video call के लिए pressure देना warning sign हो सकता है।

Online Grooming

Friendship → Trust → Private Chat → Personal Information → Private Images → Sexual Conversation → Threat या Blackmail

Child Sextortion

☞ Further photographs/video
☞ Threatening messages preserve करें।
☞ Account details note

Child Sexual Abuse Material

☞ Relevant information preserve

☞ Unnecessary access
☞ Digital evidence preserve

Digital Evidence

☞ Mobile phone
☞ Laptop
☞ Desktop
☞ Hard disk
☞ Cloud account
☞ Email account
☞ Messaging applications
☞ Browser history
☞ Download information
☞ Device logs
☞ Metadata
☞ Account information
☞ IP-related information
☞ Chat records
☞ Transaction records

☞ Material device
☞ Digital forensic examination

Section 15 POCSO

Just Rights for Children Alliance v.

Digital Evidence Delete

Device Tamper

Material Circulate

Case-specific Legal Advice

AI Deepfake and Child Sexual Abuse Material

Artificial intelligence and deepfake technology have created additional risks involving digitally manipulated sexual material.

A normal photograph of a child may potentially be manipulated using technology to create sexually explicit material.

Such cases can raise serious legal issues.

The fact that the original photograph was innocent does not automatically resolve the legal question. Authorities may examine the nature of the manipulated material, the identity of the child, creation, possession, transmission, distribution, intent and other relevant circumstances.

What Should a School Do If CSAM Is Discovered?

If suspected CSAM is discovered in a school or educational institution:

☞ Do not circulate it among students
☞ Do not upload it to a group
☞ Do not publicly identify the child
☞ Do not unnecessarily alter the device or account
☞ Preserve relevant information
☞ Restrict unnecessary access
☞ Report the matter through appropriate authorities
☞ Protect the privacy and safety of the child

The focus should remain on protecting the child and preserving evidence properly.

What Should a Company Do If CSAM Is Found on a Company Device?

If suspected CSAM is discovered on an employee’s laptop, company phone, server or official account:

☞ Restrict unnecessary access
☞ Do not circulate the material
☞ Do not destroy or reset the device
☞ Preserve relevant digital evidence
☞ Preserve relevant logs where appropriate
☞ Follow appropriate reporting procedures
☞ Maintain evidence integrity
☞ Cooperate with lawful investigation

A company should avoid conducting an informal investigation that accidentally destroys or modifies digital evidence.

Digital Evidence in CSAM Cases

Digital evidence can play an important role in CSAM investigations.

Depending on the circumstances, investigators may examine:

☞ Mobile phones
☞ Laptops
☞ Desktop computers
☞ Hard drives
☞ Cloud accounts
☞ Email accounts
☞ Messaging applications
☞ Browser records
☞ Download information
☞ Device logs
☞ Metadata
☞ Account information
☞ IP-related information
☞ Chat records
☞ Financial records where money is involved

The authenticity, integrity and chain of custody of digital evidence can be important during investigation and court proceedings.

What If a Person Is Falsely Accused in a CSAM Case?

POCSO and CSAM allegations are extremely serious, and investigations should be based on evidence.

Where material is allegedly found on a device, investigators may need to examine:

☞ How the material came onto the device
☞ Whether the person knew about it
☞ Whether it was intentionally downloaded
☞ Whether automatic synchronisation was involved
☞ Whether another person had access to the device
☞ Whether the material was transmitted
☞ Whether the material was distributed
☞ Whether the person exercised control over it
☞ Whether there was a commercial purpose
☞ What digital forensic evidence establishes

A device containing a file does not by itself answer every factual and legal question.

The surrounding circumstances, knowledge, control, intent and digital forensic evidence can be important.

Supreme Court and Section 15 POCSO

The Supreme Court has considered important questions concerning Section 15 of the POCSO Act, including issues relating to storage, possession and constructive possession or control.

The judgment in Just Rights for Children Alliance v. S. Harish & Others considered the interpretation and application of Section 15.

This makes it important to examine the complete factual circumstances of a case rather than relying on a single assumption about how a digital file came to exist on a device.

What to Do If You Receive a POCSO or Cyber Crime Notice

If a person receives a notice relating to a POCSO or CSAM investigation:

1. Do Not Ignore the Notice

Read the notice carefully and understand what is being alleged.

2. Check the Applicable Sections

Identify whether the matter refers to POCSO Sections 13, 14 or 15, IT Act Section 67B or other provisions.

3. Do Not Delete Digital Evidence

Do not attempt to destroy evidence or remove relevant records.

4. Do Not Reset the Device

Avoid factory resetting, formatting or otherwise altering a device that may be relevant to the investigation.

5. Do Not Circulate CSAM

Do not send suspected CSAM to another person even for the purpose of discussing the case.

6. Understand the Digital Evidence

In cybercrime cases, the technical evidence can be as important as the allegations.

7. Follow the Legal Process

POCSO and CSAM cases involve serious criminal provisions, and case-specific legal assistance may be appropriate depending on the circumstances.

How Parents Can Make Children Safer Online

Parents can take several practical steps:

☞ Keep communication open
☞ Teach children about online grooming
